Terms of Business

LESSONS PARTICIPANTS

Our lessons are intended for drivers wishing to obtain their QLD P1 / P2 or Open car licences by transferring their existing learner or overseas licence to QLD only.

All drivers listed below are drivers from QLD, interstate or overseas.

Drivers included in this are: 

• Unlicenced drivers (learner drivers)
• Licenced drivers (wishing to refresh their skills)

These drivers will have access to our training cars which are all fitted with Dual Controls.

Drivers NOT included in this are: 

• Accredited Driver Trainers wishing to further their skills regardless of whether it is for automatic or manual
• Any individual wishing to become an Accredited Driver Trainer either within DreamWorks Driving School or for their own development.

These drivers will need to provide their own vehicle unless otherwise advised.

Should you fall under this category any training undertaken will be separate and as such will require an application to be trained by us.

Any lessons booked, if you are not included will be cancelled.

All applications will be considered with price upon application.

ADDITIONAL FEES & CHARGES

These surcharges will be included on top of our standard lesson/ test pricing.

Surcharges are as follows:

Weekend & after-hours: $20

Public holiday: $40

Travel: $30 (for distances < 10km from pickup location)

Booking: $30 to change our days of service for auto/ manual etc

NOTE: For lessons requested on weekends & after-hours/ public holiday a minimum time and service callout charge will apply.

RESCHEDULING OF LESSONS

You are welcome to reschedule a lesson so long as you provide at least 24 hours notice. All you need to do is go online and reschedule your appointment – it’s quick and easy, the way it should be. We reserve the right to consider the Lesson cancelled and charge as set out below.

From time to time we may need to reschedule a lesson at any time, by giving you reasonable notice including by telephone, email or SMS.

If in the unfortunate event that all our lessons on the day get cancelled, you will be rescheduled unless our minimum time or service callout charge is met.

CANCELLING THE LESSON

If you wish to cancel a Lesson, you can do so through DreamWorks Driving School online booking system.

Should you cancel a lesson with less than 24 hours notice then you will forfeit your lesson fee.

We reserve the right to cancel the lesson at any time for whatsoever.

This includes but is not limited to being under the influence, speeding intentionally or any other action we deem as dangerous.

If in the unfortunate event that all our lessons on the day get cancelled, you will be rescheduled unless our minimum time or service callout charge is met.

Cancelation of the lesson will also be applied to any driver who does not meet our Terms of Business.

LATENESS AND NON-ATTENDANCE (NO SHOWS)

If you arrive late for a Lesson the Instructor may only be able to offer you the remaining Lesson time if they have a commitment to another Lesson immediately after, and you will be charged for the full Lesson.If you are more than 15 minutes late for a Lesson without notifying us we reserve the right to cancel the lesson and charge you the full cost of the lesson.

You acknowledge that:

• the Instructor has sole discretion as to whether a Lesson will commence or continue;
• the participation in a Lesson does not guarantee that you will acquire the necessary skills to pass any driving test;
• driving a motor vehicle is an inherently risky activity and there is the risk of significant personal injury or damage to property;
• we may record telephone calls received or made by us for training and quality assurance purposes;
• we do not accept any liability whatsoever for personal property that is left in a Vehicle or on our premises; and
• if you are not the Learner, you have made the Learner aware of these acknowledgements.

LIMITATION OF LIABILITY

Certain State and Commonwealth legislation, including the Trade Practices Act 1974 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These Terms do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions.

Except for any liability which cannot be excluded by law or which is caused by our negligence, our liability for any loss (whether direct or indirect), damage or liability whatsoever (including to a third party) which may be suffered in relation to the Lesson, is limited to the re-supply of the Lesson.

You agree to indemnify and keep us indemnified against any loss, damage, liability or costs whatsoever (including to a third party) in connection with:

• your breach of the Terms including the Learner’s Code of Conduct; and
• use of Your Vehicle for the Lesson.

This Limitation of Liability clause continues to have effect after this agreement is terminated.

NO WARRANTIES

If and when you are deemed competent by your Instructor, your Instructor may recommend you to sit a Queensland Transport Driving Test, however, We give no warranty or guarantee that you will:

• pass a practical driving test with a QLD Transport Driving Examiner; or
• pass any other equivalent State or Territory based test; or
• gain or develop the required skills to pass any driving test.

REFUNDS / TRANSFERS / EXPIRATION

Once a lesson pack has commenced we do not offer any refunds.

If you do not complete your lessons, remaining lessons cannot be transferred.

Lessons that are not completed within 12 months of commencement will no longer be valid.

PAYMENT

We do not currently offer any payment plans options and reserve the right to amend our pricing without notification.

Package payments to be made upfront for all lessons via the online payment or bank transfer (please request details).

Online payments can be made via the link found in the initial confirmation/ reminder emails and will incur a transaction surcharge.

Lesson packages paid for in advance and that are not completed within 12months will be automatically deemed as having expired unless otherwise advised.

All prices and charges are in Australian Dollars (AUD) and include GST.

APPLICABLE LAW

This agreement is governed by the laws of the Queensland.
